Terms and Conditions
Welcome to Hunt County Market! These Terms and Conditions outline the rules and regulations for the use of our website as a Vendor [Vendor]. By accessing or using our website [website, huncountymarket.com, Hunt County Market, or HCM], as a vendor, you agree to comply with these Terms and Conditions. If you disagree with any part of these Terms and Conditions, please do not use our website or sign up as a vendor. Individual vendors may also have supplementary terms and conditions on the individual shop page specific to the terms and conditions they have for customers.
Anyone can be a customer, but VENDORS/SHOPS are only allowed from within HUNT COUNTY TEXAS. VENDORS singing up that are NOT residents within Hunt County, Texas or have a brick-and-mortar store in Hunt County, Texas will have their VENDOR/SHOP account disabled, but will retain the ability to shop as a customer. We reserve the right to communicate with you, as a potential or signed up vendor, by the email address you provide, to ask for additional information if we are not able to determine your location from the other information you provide. We will provide a deadline, when information needs to be sent by email. If the information is not returned in time, we will disable the shop/vendor account. The intent of this website is to provide a market for residents of Hunt County to buy and sale products and services within and outside of Hunt County, Texas.
Intellectual Property:
The content, logos, designs, graphics, and other materials displayed on our website [Content] are protected by intellectual property laws and are the property of Hunt County Market or our licensors. Your content is your content and not our content. Your content is protected by intellectual property laws and is your responsibility to enforce your rights. You are prohibited from using, reproducing, distributing, or modifying any of our Content without our explicit consent. Individual shop owners own the right to shop Content. Shop owners should include additional language, if needed, on the shop page for additional restrictions you wish to have on your content. In the absence of a shop intellectual property subsection, within your Terms and Conditions, this policy and the HCM Terms and Conditions apply to your property rights. For the use of your content, if we are asked for permission, we will defer to you to grant permission.
Product Information:
We expect shop owners to provide accurate and up-to-date product information on our website and within your individual shop. However, we do not warrant the completeness, accuracy, or reliability of any product descriptions, pricing, availability, or other information displayed. We reserve the right to modify or discontinue products without prior notice that are part of our inventory. Your shop Terms and Conditions Policy should include a sub section for product accuracy. In the absence of a policy, the HCM policy is in effect.
Order Acceptance:
By placing an order through our website, you make an offer to purchase the selected products from us. We reserve the right to accept or decline your order at our discretion. If we are unable to fulfill your order, we will notify you and provide a refund if applicable.
Pricing and Payment:
All prices displayed on our website are in U.S. dollars and are subject to change without notice. We strive to ensure accurate pricing, but errors may occur. In such cases, we reserve the right to cancel or adjust orders with incorrect prices. Payment methods accepted will be clearly indicated on our website.
Returns and Refunds:
We have a 30-day return policy for eligible products as default for the website. Please refer to our Returns and Refunds Policy for detailed information on how to initiate a return, eligibility criteria, and refund procedures. However, each shop is required to have a Returns and Refunds Policy that takes precedence regarding Returns and Refunds over our default Refunds and Returns Policy for products within the individual shop.
User Accounts:
Vendors must have a user account. It is a dual use vendor and customer account. You are responsible for maintaining the confidentiality of your account information and restricting access to your account. You agree to accept responsibility for all activities that occur under your account.
Privacy:
We respect your privacy and handle your personal information in accordance with our Privacy Policy. By using our website, you consent to our collection, use, and disclosure of personal information as outlined in the Privacy Policy. Shop owners should have a Privacy Policy.
Required Policies:
Each shop is required to have a Privacy Policy, Shipping Policy, Refund and Returns Policy and a Terms and Conditions Policy. Each Policy can be as lengthy as you require or simply include the language, “We abide by the X policy of Hunt County Market.” Our policies are specific to the website itself and includes language to protect our vendors. However, vendors should ensure that they have adequate Shipping Policies and Refund and Returns Policies that reflect how you want to handle these items.
Limitation of Products for Sale by Vendors:
Vendors are not allowed to sale products that are illegal, stolen or in opposition to the sensibilities of the local community. We reserve the right to require you to remove a product if it causes real or perceived harm to the website or other vendors.
If you are not an authorized seller of a newly manufactured product, you must state that the product is for resale. Authorized sellers must provide proof to HCM before we allow a newly manufactured product to be sold on the website, where you are not the manufacturer of the product. Products should state if they are new or used or if they are new and for resale.
Items that you manufacture or create are considered new and don’t have to state they are new.
Any software or digital item that has a license, you must be in possession of the license to transfer to the buyer.
Print on Demand products are allowed, but require you to manually list those products, where you would have to process the order manually with the Print on Demand (POD) vendor, after payment has been received. This website has limited automated listing ability and integrations with Print on Demand vendors. Limitations for print on demand vendors typically only allows one website to be associated with the vendor’s website. As such, it would be Hunt County Market and not your individual shop. Due to this limitation by POD vendors, a single POD shared account would have to be used by all shops on HCM, which is not sustainable. If you are interested in automating a Print on Demand service for your shop, please contact us to see if it can be supported.
Fees and Charges:
We process all online transactions. The payment processors charge transactions fees. The payment received from an online sale is set aside in an account. At the end of each week, the payment processing fees are deducted from your proceeds along with our .05% fee (this covers our website hosting and advertising). We then transfer the remaining funds to the account you have on file. If no account is on file, we will mail you a check if we have your address. If we do not have an address for you, we will contact you to determine how to send you your funds.
Sales Tax:
We process all online transactions for you. As such we are required to capture local sales and use tax at the time of sale. The proceeds you receive will have the sales tax included in it. As such, you are required to file and pay the sales tax with the State of Texas. We do not pay the sales tax for you. All orders show an itemization of the sales tax charged and received. We charge sales tax based on Greenville, Texas sales tax rate. If you live outside of the city limits of Greenville and sale products on our website, you will need to inform us of your locality and tax rate. We will create a custom tax rate selection for you that you will choose for each product.
Limitation of Liability:
Hunt County Market, the vendors, shop owners that use Hunt County Market or any affiliated website shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use or inability to use our website or products.
Governing Law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these Terms and Conditions or your use of our website shall be subject to the exclusive jurisdiction of the courts in the State of Texas.
